Looks like Cleveland is also considering this. There’s a petition being passed around online to advocate for pausing evictions. [Eviction Moratorium in Cleveland | MoveOn](https://sign.moveon.org/petitions/eviction-moratorium)

As the federal government has stated that they will be assisting large and small businesses through this crisis, I hope they consider apartment/home rentals in the small business category, as for many, this is a source of income needed to subsidize current employment, retirement or other needed resources. What a catastrophe is the tenant not only has not income, but is destroying the property. Stay safe…

As of right now, my state, county and city do not have any moratorium on evictions (as far as I know), but I have been thinking about what I should do if a tenant does not pay me during the time of this emergency, and the recession we are almost certainly headed for due to the current emergency. I have 9 single family homes, and all my tenants are current, and among my current tenants, none of them have ever paid late, and many are 2 and 3 year tenants. But if a tenant suddenly cannot pay his or her rent due to the COVID-19 situation, I think it would be prudent to have a plan, or at least some ideas in mind, to deal with it.

The last thing I would want to do is try and evict someone during this time if they become a financial victim of COVID-19, and I would want to be reasonable in my dealings with a tenant who is put into this position.

While we can all hope the government will bail out our tenants (or us) I do not have any expectation that this will be something we can expect soon, if ever. We can hope, but hope is not a strategy!

With the country almost certainly headed into a recession, even the best paying tenant could find themselves unable to pay their rent if they lose their job or, for some of my tenants, their business falls on hard times (I have several tenants who are self employed).

I have come up with two ideas to offer to a tenant who can proved their failure to pay rent was related to COVID-19:

1. If a tenant misses one month of rent, allow the tenant’s last month rent to be used to pay their current missed rent payment. In Florida, landlords must keep any advance rent and security deposits in a separate account and the money cannot be used by the landlord for any purpose. This would allow the last month’s rent payment to be moved to my regular bank account. Of course, it would require a written agreement between landlord and tenant to be able to move the last month’s rent from the special account to the landlord’s operating account.

2. If it looks like a tenant will have a longer term hardship, it would be because the tenant has entered a severe financial situation, and likely be due to a severe national financial meltdown. In this case, I would think they should be looking for a cheaper house or living situation and should this situation occur, I am considering allowing the tenant to move out without penalty if they can do so quickly. In my case, the security deposit can be used to recover that second month’s rent, and hope there is no damage that would be paid from the security deposit, and that the tenant could be out hopefully by the end of the second month.

My objective is to be reasonable. Being reasonable, and trying to avoid eviction in the case of a tenant who is facing a severe economic hardship due to circumstances that are not his or her fault, would, I think, make any eventual eviction that may have to be done less painful. After all, I would have been a reasonable landlord!

Another possibility would be to just let the tenant live in the house indefinitely, as the City of Miami and other jurisdictions run by more liberal politicians are now requiring. Should this situation go on for very long, the amount of back rent that would pile up would likely never be able to be paid by most renters, and in that situation, a landlord will just have to eat the rent. I would like to do everything I could to avoid that situation.

If anyone has any other ideas, it would be appreciated if you could post them.

Thanks!

I have a tenant who has not not paid Feb rent nor the penalty but did pay for Mar. His lease at condo expires at end of Jun. Of course, I do not know if he will pay Apr through Jun. He has not paid required renter’s insurance and I am being fined monthly by association double more than double the cost of a year’s policy. The place he is living in is my legal address and I want to go live there when his lease is over. What if he does not want to leave. I am in another country and want to return to the United States. What choices do I have?

Illinois has a moratorium on evictions due to C19.
